Rights to information

On July 1 2010, the Government Information (Public Access) Act 2009 [GIPA] commenced. This new legislation introduced a new 'right to information' system to New South Wales, replacing the existing Freedom of Information (FOI) system which had been operating since 1989.

This new legislation creates new rights to information that are designed to meet community expectations for more open and transparent government. It also encourages proactive information disclosure through mandatory publication and authorised release of 'open access information'. 'Open access information' is information that Council must publish, unless there is an overriding public interest against disclosure (OPIAD).

Kogarah City Council possesses a variety of information that relates to the operation of Council and the Kogarah City Council Local Government area. Under the GIPA legislation this information is grouped into four categories:

  • Mandatory open access information;
  • Proactive release information;
  • Informal application information: and
  • Formal application information (an application fee of $30 applies)

Kogarah City Council promotes open government and greater accountability to the community. The majority of Council's documents are available to the public unless there is an overriding public interest against disclosure. Examples of documents that are not permitted are internal working plans of another individual's property and Council's own legal advice. Also other person's personal information is restricted under the Privacy and Personal Information Protection Act 1998.
